This chapter measures money and security. It sets out how much money you can receive, how much you can be excused from paying, what services you can get and what conditions you must meet, without converting any of it into years of life. Policies change every year and differ from place to place, so for amounts and thresholds, go by what your locality has published for the current year. The items are ordered like this: those that cost nothing, involve little paperwork and work quickly come first. Those that require building up long-term eligibility, or that vary a lot from place to place, come later. Those based only on experience, with no official document behind them, come last.
The items in this chapter are grouped by topic below. The numbers in parentheses are item numbers.
Lost your job: apply online for unemployment insurance benefits (Item 1), get recognized as a person with employment difficulties (Item 12), claim vocational training subsidies (Item 13).
Owed wages: complain to labor inspection first (Item 2), apply for legal aid (Item 3), if you are owed wages, first work out who employs you (Item 22).
Emergency safety net: go to a relief station (Item 4), apply for temporary assistance (Item 6), apply for the minimum living allowance (dibao, 低保; Item 7), the two disability subsidies (Item 8), replace a lost ID card right away (Item 11), when you truly have nowhere to sleep (Item 21).

While you are collecting, unemployment insurance pays your employee medical insurance for you.

You can submit the application from your phone through any of three channels: the “Zhangshang 12333” (掌上 12333) app, the electronic social security card mini-program in WeChat or Alipay, or the National Social Insurance Public Service Platform. All you need is your social security card or ID card, and in most regions you do not have to go in person. The prerequisite is that you have first completed unemployment registration.

Three conditions must all be met. First, your employer and you have paid unemployment insurance for a cumulative total of 1 year. Second, you did not resign on your own initiative (the law calls this “interruption of employment not by one's own will”). Third, you have completed unemployment registration and you intend to look for work. How long you can collect depends on how many years you have paid. A cumulative 1 year but under 5 years: at most 12 months. 5 years but under 10 years: at most 18 months. 10 years or more: at most 24 months. How much is paid each month is set by the provincial government and differs from province to province. The amount is lower than the local minimum wage and higher than the urban dibao. The national goal is to raise it gradually to 90% of the minimum wage standard. While you are receiving unemployment insurance benefits, you remain enrolled in employee basic medical insurance and keep its benefits. The basic medical insurance premium that is due is paid from the unemployment insurance fund; you pay nothing yourself (nationwide, the regulations have been in force since 1999)

If you resign on your own initiative, it does not count as “not by one's own will,” and you cannot collect. So when you leave a job, do not sign “resigned voluntarily for personal reasons”; see Section 19, Item 7. Unemployment insurance benefits are counted from the day you complete unemployment registration, so registering a month late means getting a month less money. The first thing to do after you leave is register. Registration requires the separation certificate issued by your employer; see Section 19, Item 17 (separation certificate). For whether you have to honor a non-compete agreement, and what to do if the company does not pay compensation for it, see Section 11, Item 12 (signed a non-compete agreement). During the benefit period, unemployment insurance pays your employee medical insurance for you. Amounts differ a lot between provinces; go by what is published where you are insured. The “90% of the minimum wage” comes from a 2017 guidance opinion of the Ministry of Human Resources and Social Security and the Ministry of Finance (Renshebufa [2017] No. 71), whose exact words are “gradually raise the unemployment insurance benefit standard to 90% of the minimum wage standard.” This is a target; it does not mean benefits are paid at 90% now. The original page on the Ministry of Human Resources and Social Security website would not open on this machine, so this sentence was checked against the quotation in a document of the Liaoning Provincial Department of Human Resources and Social Security.
If you are owed wages, first complain to labor inspection, then apply for labor arbitration; neither route charges a fee, and most cases get a result within a few months

Neither route costs money. First call 12333, or go to the human resources and social security bureau and complain to labor inspection. Once a case is opened, the investigation is finished within 60 working days; the company can be ordered to pay within a deadline, and if it still does not pay by then, it must pay an extra 50% to 100% in compensation. If that does not work, apply for labor arbitration, which closes the case within 45 days. But “case closed” does not mean “money received”: if the company has no assets or the boss has run off, you may win and still not get the money.

Free; neither the complaint nor arbitration charges a fee. Gather your employment contract, pay slips, attendance records, bank transfer records and chat records, and make 1 to 3 trips to the human resources and social security bureau or the arbitration commission. There is a 1-year time limit for applying for arbitration (the legal term is the arbitration limitation period). If you still work for the employer and your wages are in arrears, this 1-year limit does not apply. If you have already left, you must file within 1 year of the day you left. The hard part is the trip after trip and the evidence gathered piece by piece; it is easy to lose heart along the way.

Step one is the complaint. Call 12333, or go to your local human resources and social security bureau and complain to labor inspection. The law requires the investigation to be finished within 60 working days of the case being opened; complex cases can be extended by another 30 working days. If the facts are confirmed, the company can be ordered to pay within a set deadline. If it still has not paid when the deadline passes, it must pay an additional compensation of 50% to 100% of the amount due. In 2024, inspection bodies nationwide investigated and dealt with 137,000 cases, recovering 8.65 billion yuan in wages for 654,000 people. If you hold an IOU or a payroll record and the facts of the unpaid wages are clear, you can also apply directly to a basic-level court for a payment order. A payment order is the court's order to the company to pay; it is issued within 15 days after the court accepts the application. Step two is arbitration. The law requires the case to be closed within 45 days of acceptance, extendable by 15 days. In a wage claim you can apply for advance enforcement: part of the claim is enforced before the whole case is decided. Where the amount owed does not exceed 12 times the local monthly minimum wage, the award is final: once arbitration rules, the matter is settled and the company cannot take it to court. In 2024, 4,257,000 cases were handled nationwide and 4,156,000 were concluded. The amount in concluded cases was 93.47 billion yuan. The mediation success rate was 79.6%, the arbitration case-closing rate 98.2% and the arbitration finality rate 73.7%. When people say this drags on for “half a year to a year,” they mean the cases that go on to court after arbitration: 6 months for the first instance (3 months under the simplified procedure), plus 3 months for the second instance. In 2024, courts concluded 88,000 cases claiming labor remuneration, recovered 28.54 billion yuan, and 998 people were sentenced for the crime of refusing to pay labor remuneration (nationwide)

Complaints and arbitration work, but keep “case closed” and “money received” apart. The 98.2% case-closing rate only means the procedure was completed. If the company has no assets or the boss has run off, you can win and still not get the money. The Supreme People's Court publishes only the total amount actually enforced (2.3 trillion yuan in 2024) and says that the “rate of cases fully enforced remains high”; there are no official figures on how much of the money in unpaid-wage cases actually ends up in the claimants' pockets. The statistical bulletin does not define the term “arbitration finality rate”; this item reads it as “not taken on to court after the award.” Once unpaid wages reach a certain amount, the case meets the threshold for opening a criminal case. One situation is owing one person 3 months or more of wages, in an amount of 5000 to 20,000 yuan or more. The other is owing 10 or more people, a total of 30,000 to 100,000 yuan or more. In either situation, if the employer still does not pay after being ordered to, the threshold for opening a case is met. Each province's high court and provincial procuratorate set the province's specific amount within this range and publish it; before you complain, look up your province's figure, and raise it in person when you complain. Migrant workers on construction sites are also covered by separate rules on dedicated wage accounts and on the general contractor paying first, so going to the general contractor works better than going to the labor subcontractor (包工头). Both routes assume there is an employing unit. Workshops and shops with no business license still count, and you can complain and apply for arbitration. Private work for a household or an individual, such as working as a nanny, is not an employment relationship, and you have to go to court; see Item 22 (first work out who employs you). Migrant workers who apply for legal aid to recover wages are not checked for financial hardship. The texts of the Employment Contract Law (劳动合同法) and the Civil Procedure Law (民事诉讼法) are cited from pages reposted by the State Taxation Administration and the Guizhou Provincial Administration for Market Regulation (both gov.cn), because the pages on the National People's Congress website would not open. On entering, you must truthfully register your name and the belongings you have with you. The hard part is telling someone that you have no money and nowhere to go.

Relief stations provide food that meets hygiene requirements and a place to stay. If you come down with a sudden acute illness at the station, you are sent to a hospital for treatment. They also help you contact your relatives and your employer. If you have no money for a ticket back to your place of household registration or your place of residence, they issue a travel voucher for a bus, train or boat, that is, a ticket. Your place of household registration is your hometown; your place of residence is where you currently usually live. Relief usually lasts no more than 10 days. It can be extended for people waiting for family to collect them, waiting for treatment or waiting for placement. When police and other administrative officials on duty come across people who are homeless and begging, they should tell them they can go for help. Disabled people, minors, older people and people with limited mobility should be guided and escorted there (nationwide, since 2003)

At the end of 2024, the national average urban dibao standard was 798.1 yuan per person per month, and the rural standard 593.9 yuan per person per month. Urban dibao covered 6,250,000 people and rural dibao covered 33,615,000 people. Dibao is paid monthly as a difference: the local dibao standard minus household income per person. For example, if the local standard is 798.1 yuan and your household's income is 500 yuan per person per month, each person receives 298.1 yuan a month, not 798.1 yuan. The dibao standard is set like this: take local residents' per capita consumption expenditure for the previous year, multiply it by a set ratio, and adjust it at intervals. Put simply, it takes how much the average local person spent in the past year and marks it down (national average; varies by place)

Dibao is the last line of protection, and you have to apply in the place of your household registration. If your family's home, car or savings exceed the local limits, or your children are able to support you, you may not be approved. Once approved, there are other benefits too: help with resident medical insurance contributions (resident medical insurance: see Item 9), access to medical assistance when you see a doctor (medical assistance: see Item 10), and no financial-hardship check when you apply for legal aid (legal aid: see Item 3).

On top of what you pay yourself, public finances add a per-person subsidy. In 2024 it was no less than 670 yuan; in 2025 it rose by 30 yuan over the previous year to no less than 700 yuan, while the individual contribution stayed at no less than 400 yuan (Yibaofa [2025] No. 22, as restated in provincial documents). The 2026 Government Work Report (政府工作报告) says it will rise by another 24 yuan. For dibao recipients and people under extreme-poverty support, eligible medical costs left over after medical insurance reimbursement can be reimbursed again through medical assistance at a rate of no less than 70%. The cost of a lapse is a waiting period. The National Healthcare Security Administration's 2025 notice (Yibaofa [2025] No. 22) has not been publicly posted on the administration's website or on the Chinese government website. The two figures, 700 yuan and 400 yuan, agree in documents from Hebei and Anhui provinces, and the Anhui document states that it follows this notice. While you are receiving unemployment insurance benefits, unemployment insurance pays your employee medical insurance for you, so you do not need to enroll a second time.

Step four: if you are still working, take sick leave under the medical treatment period, which is the period during which you are off work because of illness and cannot be dismissed; if it is a work injury, go through work-injury insurance. Step five: if you cannot repay your credit card, take the initiative to ask the bank to negotiate installments. Step six: only if it is truly not enough, raise money on a personal help-seeking platform designated by the Ministry of Civil Affairs. The main documents are the diagnosis certificate, the itemized bill and the settlement statement; it takes 2 to 4 trips. The hard part is having to run around doing paperwork again and again while you are ill.

The state calls basic medical insurance, serious illness insurance and medical assistance together the “triple system,” which catches you layer by layer. For dibao recipients and people under extreme-poverty support, eligible medical expenses are covered by assistance at no less than 70%. Seriously ill patients who were not poor to begin with but were made poor by medical bills can apply on their own and then be given assistance. If you register before being hospitalized in another province, you can settle directly when you are discharged, without first paying the full amount and then claiming it back in the place where you are insured. When illness keeps you off work, you have a medical treatment period of 3 to 24 months, its exact length depending on your years of work. During this period the company may not terminate your employment contract, and sick pay may not be less than 80% of the local minimum wage. Workers with a work injury have a paid suspension period, that is, the time off work while recovering from the injury; their original wages and benefits continue unchanged, paid monthly by the employer, usually for no more than 12 months. If your credit card debt exceeds your ability to repay and you are willing to repay, you can negotiate a personalized installment plan with the bank, which reorganizes the debt into a new repayment schedule of up to 5 years; once an agreement is signed, the bank must stop collection. Personal help-seeking platforms that raise money online for an individual must be designated by the civil affairs department of the State Council. The platform must verify that the request for help is genuine. Donations may be paid only to the person seeking help, or to an account that person provides (nationwide)

What share medical assistance covers, and the maximum it pays in a year, are set by the place where you are insured. The medical treatment period has six tiers, depending on how many years you have worked in total and how many years you have worked for this employer. Once the medical treatment period is over, the company may be able to end your contract lawfully, so find out in advance which tier you are in. People receiving emergency rescue treatment are also on the list of those who need to register. The National Healthcare Security Administration page does not say whether emergencies count as registered automatically or whether you can register afterward; call the place where you are insured to ask. Do not touch online loans or high-interest private loans. Courts protect interest only up to 4 times the one-year LPR (for not borrowing at usurious rates, see Item 15). The part above that line is not protected, but you still have to repay the principal. Lying in a hospital bed, you also have no energy to fight that kind of lawsuit. Sudden serious illness or injury is a different matter: even with no money, call 120 (ambulance); hospitals may not refuse, pass off or delay treatment, and emergency costs for that stage are paid by the disease emergency assistance fund; see Section 24, Item 8 (the emergency department must treat you first). Those in hardship are helped to resettle, and given assistance and support according to law, by the government of their place of household registration or residence (Prison Law (监狱法), revised in 2026, in force from November 1). A 2010 central document requires stronger vocational training for them, inclusion in dibao for those who qualify, and the establishment of transitional resettlement bases. For people who were under 18 at the time of the offense and were sentenced to 5 years or less, criminal records are sealed, and they need not report them when joining the military or looking for work; if the person applies for a certificate of no criminal record, it is issued within 3 working days. The term on the defaulter blacklist is 2 years. If you pay in full, or reach a settlement with the other party, among other situations, the court should remove your name within 3 working days. The Regulations of the Shenzhen Special Economic Zone on Personal Bankruptcy (深圳经济特区个人破产条例) are currently the only personal bankruptcy legislation; after being declared bankrupt and getting through a 3-year observation period, debts not yet repaid can be discharged. When an enterprise legal person cannot pay debts that are due and owes more than it has (this is called insolvency), it can apply for reorganization, settlement or bankruptcy liquidation, and the debts are wound up together with the enterprise (nationwide; personal bankruptcy only in Shenzhen)

Adults' criminal records are not sealed. Article 100 of the Criminal Law (刑法) requires people to report truthfully that they have received a criminal penalty when joining the military or looking for work. Occupations such as civil servant, judge, lawyer and teacher, as well as political background checks, are subject to further statutory restrictions. In the text of the Prison Law (监狱法) in force before November 1, 2026, the corresponding provisions are Articles 37 and 38; go by the text in force for the article numbers. The original page of Zhongbanfa [2010] No. 5 could not be found on the central government website; it was taken from a district government's repost. During the observation period of personal bankruptcy, you may not fly first class, may not spend extravagantly and may not buy a home; 8 categories of debt, such as compensation for intentionally injuring another person, are not discharged; and a discharge obtained by fraud can also be revoked. Officially, these products are divided into two kinds. Medical insurance reimburses the medical costs you actually incur. Disease insurance pays a lump sum of the agreed amount directly as soon as you are diagnosed with one of the diseases specified in the contract. Both cover what you still have to pay yourself after medical insurance reimbursement, and the loss from being off work. Policies with a term of one year or less whose terms do not state guaranteed renewal are short-term health insurance. Only those longer than one year, or that state guaranteed renewal, are long-term health insurance. “Guaranteed renewal” means that when the policy comes up for renewal, the company must keep covering you on the original terms and at the agreed premium rate. Insurers may not induce the same person to buy more than one expense-reimbursement medical insurance policy with the same or similar coverage. The disease definitions for critical illness insurance follow a unified industry standard, which includes 28 severe diseases and 3 mild diseases. It is graded B because the authorities give only definitions and rules, with no figures on “how much buying it saves.” “Million-yuan medical insurance” is a sales name; under the regulations it counts as short-term health insurance. If the terms do not include “保证续保” (guaranteed renewal), the product may be discontinued next year or its price may go up, so look for these four characters in the terms before you buy. With two medical insurance policies that both reimburse actual expenses, the same expense cannot be reimbursed twice, so don't stack them. If you already have an illness when you take out the policy and do not disclose it truthfully, your claim will be denied when something happens. Truthful disclosure has a two-year limit: once the contract has been in force for two full years, the insurer can no longer rescind it on the grounds that you did not disclose truthfully, and it has to pay if something happens. If within two years you are found to have deliberately failed to disclose, events that occur before the contract is rescinded are not paid, and the premiums are not refunded. Article 2 of the Employment Contract Law (劳动合同法) limits employers to organizations such as enterprises, individual economic organizations and private non-enterprise units; natural persons are not among them. The Supreme People's Court's judicial interpretation on labor disputes lists several kinds of disputes that are not labor disputes. One, disputes between a household or individual and domestic workers. Two, disputes between individual craftsmen and their helpers or apprentices. Three, disputes between rural contracting households and the people they hire. These have to be taken to court as ordinary civil disputes, with a limitation period of 3 years. Employers with no business license are not within this exception. Article 93 of the Employment Contract Law provides that where an employer lacks legal business qualifications and the worker has already performed work, the employer or its investors shall pay the labor remuneration, severance and compensation. Article 29 of the interpretation provides that where a worker has a dispute with an employer that has not obtained a business license, whose business license has been revoked, or that continues operating after its business term has expired, the employer or its investors shall be named as parties. Article 33 of the Regulations on Labor Security Supervision (劳动保障监察条例) provides that where a party without a business license, or whose business license has been revoked according to law, employs workers, the labor security administrative department carries out labor security supervision. Where an individual contractor illegally recruits workers and causes them harm, the organization that contracted out the work and the individual contractor bear joint and several liability for compensation (Article 94 of the Employment Contract Law). Where a project owner or general contractor contracts out or subcontracts a project to an individual or to an entity without legal business qualifications, leading to unpaid wages for migrant workers, the project owner or general contractor pays them off (Article 36 of the Regulations on Ensuring Payment of Wages to Migrant Workers (保障农民工工资支付条例)) (nationwide)

Judge in this order. First, check whether the work was passed down from a company or a construction site; if so, go to the company that contracted it out or to the general contractor. For dedicated wage accounts on construction sites and the general contractor paying first, see Item 2 (if you are owed wages, complain to labor inspection first). Next, check whether the other party is doing business: those running a shop, a factory or a workshop go through inspection and arbitration whether or not they have a license, and in arbitration, name the boss personally as a party as well. What remains, private work for a household or an individual, is the only kind that goes to court. If you hold an IOU, you can first apply for a payment order, and small amounts can go through small-claims procedure; see Section 8, Item 22 (cheated in a second-hand deal, small claims). The limitation period is 3 years; see Section 8, Item 19 (deadlines for asserting your rights). No route guarantees the money reaches you; if the other party has no assets, you can win and still not get the money.
